A medico-legal analysis in a personal injury case is a comprehensive report submitted as an expert witness to a trier of fact, so a party in a court of law can obtain medical expert testimony as to the nature, extent, and cause of a particular person s injury. Sometimes called a medico legal review, it is usually presented as a legal document prepared by a medical expert to accompany another form of an expert transcript. It has the force of law to support the conclusions reached in any investigation or court proceedings and is usually prepared by a medical doctor specializing in treating injuries caused by negligence, recklessness, or deliberate actions. MAJOR BENEFIT OF MEDICO-LEGAL EXAMINATIONS The major benefit of medico-legal examinations is the reliability it offers. They are thorough and very accurate, not only in identifying injuries but also in gathering additional information that is pertinent to the proceedings. For example, there may be doubts about the amount of compensation to which a claimant should be entitled. Such doubts could arise due to misdiagnosis or even non-pecuniary damage. In such cases, medico-legal evaluations will help the trier of fact to arrive at the right compensation amount. 1)- Medico-Legal examinations are important in two ways. Firstly, they help gather the information that is vital in assessing the compensation benefits for the injured person. More importantly, they allow the doctor or other experts to make a convincing case for the injured person's total compensation claim. This process is called settlement analysis. During this analysis, doctors for hire refer to several factors such as the medical records, clinical examinations, radio logical examination reports, police reports, etc., to determine the extent or the causal relationship between the incident and the injury. Furthermore, medico-legal professionals who have conducted similar examinations can testify about the reliability of their findings 2)- The second way in which professional medico-legal evaluations play an important role is by allowing the experts to make a reasonable estimation of future compensation benefits. This is based on the reasonable estimation of what a normal employee would earn in his or her absence. This is done by estimating how much an employee would have made based on several factors such as previous years of work experience, educational qualifications, occupational duties, health, and other personal characteristics. The process is sometimes complex, and it requires the expertise of at least three experts in order to estimate the salary of the employee. Moreover, witnesses are also called upon to give evidence about the quality of the medical evidence, the importance of certain aspects of the evidence, the timeliness of the investigations, etc. Such witnesses may also act as legal advocates for the complainants in personal injury claims. 3)- Medico-Legal evaluations are not only important for courts but also important for injured people. In the United States, they are frequently used by attorneys to represent their clients before courts. They prepare personal injury reports, which are needed to support the claim of the injured people. Thus, medical-legal reports can help an injured person to obtain compensation for wrongs done by other people. DIFFERENT WAYS IN WHICH MEDICO-LEGAL REPORTS CAN BE USED AS EVIDENCE There are many ways in which a medico-legal report can be used as evidence in a court. For instance, if a lawyer of an insurance company wants to show the court that the claimant had been receiving regular treatment at a well-known hospital when he or she was ill, the expert witness will be able to corroborate this point. He or she may also be able to prove that the claimant had been getting regular treatment even when he or she was ill. He or she may also give enough details about the doctor who had been handling the patient. CONCLUSION: The attorney handling the personal injury claim can then use these medico-legal reports to prove that the hospital where the patient had received treatment was not the one meant for treating the patient.

Thanks for clearing up how medical-legal evaluations can help the court but they can also benefit the injured people involved. No one wants to be robbed of their compensation when trying to pay for medical bills. Having your injuries and recovery evaluated properly could hopefully prevent you from losing a ton of money.
